The rules for using Que pense Michel

These terms are written by the editor of Que pense Michel. They are intentionally plain and short — every section starts with a one-line summary so you can read what matters in two minutes.
1.Accepting these terms
In plain English: By using Que pense Michel, you agree to these rules. You must be 18+.
Que pense Michel is a humour-driven service that turns an exported chat into an entertaining report. By creating an account, uploading a chat, or buying a report, you accept these terms in full. If you don't accept them, don't use the service.
You must be at least 18 years old. If you upload a chat that mentions other people, you confirm you are entitled to share that content with us for the sole purpose of generating a report.
2.Definitions
In plain English: A few words we use throughout this page.
- Service
- The Que pense Michel website, app and reports available at quepensemichel.com.
- User
- Anyone who uses the Service, with or without an account.
- Chat
- A conversation file (WhatsApp, iMessage…) you upload to be analysed.
- Report
- The humorous, AI-generated document produced from a Chat.
- Edition
- A paid tier of the Report (Light, Deep, etc.) with different sections.
- Promo code
- A code that grants a discount at checkout, with its own conditions.
3.What the Service is — and isn't
In plain English: It's entertainment. Don't make life decisions based on a Report.
The Report is a comedic interpretation produced by an AI model. It is meant to make you smile and spark conversation among friends.
The Report is not a psychological, medical, legal, HR or relationship assessment. It has no evidentiary value and must not be used to take any serious decision about a person, a relationship or a situation.
4.Your account
In plain English: We sign you in with a magic link. Keep it private. You can delete your account anytime.
- Sign-in uses a one-time link sent by email. Don't share it.
- Keep your email address up to date so we can reach you about your purchases.
- You can delete your account at any time from the dashboard. Deletion is immediate and irreversible (see our privacy policy for what we erase).
5.The chat you upload
In plain English: Only upload chats you have the right to share. We use them only to generate your Report.
By uploading a Chat, you grant us a limited, non-exclusive, worldwide licence to process it for the sole purpose of generating and delivering your Report. This licence ends when the Report is generated; we do not keep raw messages beyond what our privacy policy describes.
- You confirm you are lawfully in possession of the Chat.
- You confirm the people in the Chat would reasonably expect this kind of light analysis, or you have another lawful basis to share it.
- You don't upload content involving minors as a primary subject.
- You don't upload content that is illegal, threatening or designed to harm someone.
- You don't upload special-category data (health, religion, sexuality, political opinions…) that isn't necessary for the joke.
6.Acceptable use
In plain English: Use Que pense Michel to have fun. Don't use it to harm people or break the Service.
- No harassment, doxxing, defamation or threats targeting any person.
- No use of the Report to impersonate someone or fabricate evidence.
- No scraping, reverse engineering, automated mass generation or resale.
- No attempt to bypass payment, abuse promo codes or interfere with other users.
- No content that is unlawful in your jurisdiction or ours.
7.AI-generated content
In plain English: The Report is written by an AI and is intentionally exaggerated for comedy.
Reports are generated by large language models. They may contain inaccuracies, embellishments and tongue-in-cheek caricatures. They reflect a comedic interpretation, not the editor's opinion of the people mentioned.
Don't present a Report as a factual statement about anyone. Share it for what it is: a piece of entertainment.
8.Pricing & purchase
In plain English: Prices are in euros, taxes included. Payment is handled by Stripe.
- All prices are displayed in € including applicable taxes at checkout.
- Payment is processed by Stripe; we never see or store your full card details.
- An order is final once payment is confirmed and generation has started.
- Promo codes are subject to the conditions shown at checkout. They are not cumulative unless explicitly stated.
9.Right of withdrawal (EU consumers)
In plain English: Because the Report is generated immediately, you waive your 14-day withdrawal right once generation has started.
Under EU and French consumer law (article L221-28 13° of the French Consumer Code), the right of withdrawal does not apply to the supply of digital content not delivered on a tangible medium when performance has begun with your prior express consent and acknowledgement that you thereby lose your right of withdrawal.
By confirming a purchase, you expressly request that generation of your Report begins immediately and you acknowledge that you lose your right of withdrawal as soon as generation starts. If a Report has not yet been generated, you can request a full refund within 14 days at the email below.
10.Refunds & failed generations
In plain English: If we fail to deliver a Report, we refund you.
If a generation fails for technical reasons and we are unable to deliver the Report after a reasonable retry, contact us and we will issue a full refund for that Report. Refunds for any other reason are handled on a case-by-case basis at our discretion.
11.Intellectual property
In plain English: We own the Service. You get a personal licence to enjoy and share your Report.
The Service, including the brand “Que pense Michel”, the code, design, prompts, templates and copy, belongs to the editor and is protected by intellectual property law.
Once paid, you receive a personal, non-exclusive, non-transferable licence to view, download and privately share your Report with friends. Public sharing is tolerated as long as it doesn't harm the people mentioned. Any commercial use, resale or systematic redistribution of Reports requires our prior written consent.
12.Moderation & suspension
In plain English: We can remove a Report or close an account that breaks these rules.
We may, at our discretion and without prior notice, refuse an upload, revoke a share link, take down a Report or suspend an account if we reasonably believe these terms have been broken — in particular in case of harassment, illegal content or repeated abuse. In case of manifest violation, no refund is due.
13.Availability
In plain English: We do our best to keep it running, but we don't promise zero downtime.
The Service is provided on an “as is” and “as available” basis. We may suspend access for maintenance, security or because a third-party provider (payment, AI, hosting, email) is degraded. We don't commit to a specific service level.
14.Limitation of liability
In plain English: If something goes wrong on our side, our liability is capped at what you paid us.
To the maximum extent permitted by applicable law, our aggregate liability for any claim arising out of or related to the Service is capped at the amount you paid us during the twelve (12) months preceding the event giving rise to the claim. We are not liable for indirect or consequential damages, loss of data, loss of opportunity or loss of reputation. Nothing in these terms limits any liability that cannot be lawfully limited (notably bodily injury caused by negligence, gross negligence or wilful misconduct).
We are not liable for failures caused by events beyond our reasonable control (force majeure), including outages of third-party providers.
15.Your responsibility towards third parties
In plain English: If you misuse a Report and someone complains, that's on you.
You agree to defend, indemnify and hold us harmless against any third-party claim arising from a Chat you uploaded without the right to do so, or from a misuse of a Report — in particular when used to harass, defame or harm a person.
16.Third-party providers
In plain English: We rely on a small number of trusted providers. See our privacy policy.
Generating, delivering and billing a Report involves third parties (payment, AI model, hosting, transactional email). The list and safeguards are detailed in our privacy policy.
17.Changes to these terms
In plain English: We may update these terms. Material changes are announced.
We may update these terms to reflect product, legal or security changes. For material changes, we will notify active users by a banner or by email. The “last updated” date at the top of this page always reflects the current version.
18.Governing law
In plain English: French law applies. EU consumers keep their local protections.
These terms are governed by French law. Disputes shall be brought before the competent courts of Paris, subject to mandatory consumer protection rules that may allow a consumer resident in the European Union to bring proceedings in the courts of their place of residence.
